Cove Drivers App – Personal Vehicle Terms & Conditions

Introduction
These Cove Drivers App Personal Vehicle Terms and Conditions ("Vehicle Terms") apply to delivery partners ("you", "Driver") who use a personal vehicle (car, scooter, motorcycle, or other permitted vehicle) to perform deliveries arranged through the Cove Drivers App and related services (the "Driver Services"). These Vehicle Terms are in addition to the Cove Delivery Person Agreement and Community Guidelines and form part of the contract between you and Cove (Bermuda) Ltd ("Cove").
1. Your Vehicle Is Your Responsibility
You agree that:
- You have access to a car, or equivalent vehicle, capable of safely performing deliveries.
- You are using your own vehicle (not a Cove vehicle) unless Cove expressly provides otherwise in writing.
- You are solely responsible for the purchase, maintenance, repair, and operation of your vehicle.
- You are solely responsible for all costs of operating your vehicle, including fuel, maintenance, insurance premiums, taxes, licensing, and any tolls or parking fees.
2. Licensing, Registration, and Roadworthiness
You must:
- Hold a valid Bermuda driver's license appropriate for your vehicle;
- Ensure your vehicle is properly registered and licensed as required by law; and
- Keep your vehicle in safe, roadworthy condition at all times.
You agree not to use a vehicle with known safety issues, expired registration, or without required inspections.
3. Insurance Requirements
You must maintain, at your own cost, valid motor vehicle insurance as required by Bermuda law. You are responsible for ensuring your insurance covers your use of the vehicle for delivery work (commercial use) and for any passengers (if any). Upon request, you must provide proof of insurance to Cove. If your insurance lapses or is cancelled, you must immediately stop performing Driver Services and notify Cove.
4. Safety and Legal Compliance
You must comply with all applicable laws and regulations, including road traffic laws. You must not:
- Drive under the influence of alcohol or drugs;
- Speed, drive dangerously, or ignore traffic signs; or
- Use your phone in a way that is illegal or unsafe while driving.
You must follow safe delivery practices, including securing items so they do not fall, spill, or create hazards.
5. Accidents, Incidents, and Reporting
If you are involved in an accident, incident, or near miss while performing Driver Services, you must:
- Follow the law and any emergency procedures;
- Seek medical attention if needed;
- Notify the appropriate authorities if required; and
- Notify Cove as soon as reasonably possible through the app or by email.
You agree that Cove is not your insurer and does not provide personal injury, vehicle damage, or liability coverage for you, except where Cove has expressly agreed in writing.
6. Tickets, Fines, and Violations
You are solely responsible for any parking tickets, speeding tickets, fines, penalties, towing charges, impound fees, or other violations you incur while performing Driver Services. Cove will not reimburse you for these costs.
7. No Employment Relationship
Unless you have a separate written employment agreement with Cove, you acknowledge that you are an independent contractor and not an employee, agent, or representative of Cove. You have no authority to bind Cove. Nothing in these Vehicle Terms guarantees any minimum amount of work, earnings, or hours.
8. Indemnity and Release
To the maximum extent permitted by law, you agree to release, defend, indemnify, and hold harmless Cove from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your vehicle operation;
- Any accident, injury, death, or property damage arising from your acts or omissions; and
- Any tickets, fines, or violations.
Nothing in this section limits any liability that cannot be excluded under applicable law (for example, liability for fraud).
9. Termination
Cove may suspend or deactivate your access to Driver Services if you violate these Vehicle Terms, fail to maintain required insurance, create safety risk, or if required by law.
